1. Who we are and about these terms
This website is operated by Fish4Flies Ltd ("Fish4Flies", "we", "us", "our"), a company registered in England and Wales (company number 5656895) at 12 Warren Drive, Wickford, Essex, SS11 8NE. VAT number GB869774154. You can reach us through our Contact Us page, which includes a free call-back service.
These terms apply to orders placed on fish4flies.com, fish4flies.co.uk and fish4flies.eu. The version of these terms published on the website at the time you place your order is the version that applies to that order. We may update these terms from time to time; the date above shows when they last changed.
If you are buying as a consumer, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you are buying on behalf of a business, you confirm that you have authority to bind that business.
2. Ordering
When you place an order we send an acknowledgement email setting out what you have ordered. That email is confirmation that we have received your order, not acceptance of it. A contract is formed when we dispatch the goods to you. We may decline an order, for example where an item is unavailable, where there has been an obvious pricing error, where payment was not authorised, or where we cannot deliver to your address; if we decline an order you have paid for, we will refund you in full.
3. Prices and payment
Prices and delivery charges are shown at checkout in your selected currency (pound sterling, euros or US dollars). UK VAT is included where it applies. For deliveries within the EU we collect VAT at checkout where indicated; for other international deliveries, any import taxes, duties or fees charged in the destination country are your responsibility unless stated otherwise at checkout.
Payment is taken at the time you place your order. Card payments are processed securely by our payment provider (Stripe); your full card details are never held on our systems.
While we work hard to keep every price accurate, mistakes can happen. If we discover an obvious error in the price of goods you have ordered, we will contact you and give you the option of reconfirming the order at the correct price or cancelling it with a full refund. If we cannot reach you, we will treat the order as cancelled.
4. Delivery
Delivery options, charges and estimated timescales are shown at checkout. In-stock items are typically dispatched on the next working day. Patterns tied to order (including library patterns and pattern requests) take longer; depending on where we are in our tying cycle this can be a month or two, and we will keep you informed.
We are responsible for the goods until they are delivered to the address you gave us; risk in the goods passes to you on delivery (or on delivery to a person you nominated to receive them). If your order has not arrived within a reasonable time of the estimate, please contact us and we will investigate and, where appropriate, resend the goods or refund you.
5. Changing your mind (your 14-day cancellation right)
As a consumer you may cancel your order for any reason up to 14 days after the day you (or your nominee) receive the goods, under the Consumer Contracts Regulations 2013. To cancel, tell us within that period through the Contact Us page or by email; a clear statement that you wish to cancel is enough.
Please return the goods to us, unused and in their original condition, within 14 days of telling us you wish to cancel. You are responsible for the cost of the return unless the goods are faulty or misdescribed. We will refund you within 14 days of receiving the goods back (or of you providing evidence of return), including the cost of standard delivery; if you chose a premium delivery option we refund the standard delivery cost.
The cancellation right does not apply to flies tied to your own specification (for example bespoke pattern requests or custom size and dressing options tied for you), as permitted by the regulations. This exception never affects your rights in relation to faulty goods.
6. Faulty or misdescribed goods
Under the Consumer Rights Act 2015 our goods must be of satisfactory quality, fit for purpose and as described. If something is wrong, contact us: within 30 days of delivery you are entitled to a full refund; after that we will replace the goods or, if we cannot, refund you. We refund return postage for faulty or misdescribed goods. These rights are in addition to, not instead of, your cancellation right above.
7. Product information and safety
The fishing information on this website (pattern histories, tactics, seasonal advice and similar) is distilled from many sources and offered in good faith as guidance; fishing being fishing, we cannot promise results.
Safety: our products contain sharp hooks and are not toys. Keep them out of reach of children, do not allow children to handle them without adult supervision, and wear suitable eye protection when handling and using them.
8. Pattern requests
Requesting a pattern, size or option is free and does not commit you to buy. Depending on our tying cycle a request can take a month or two to arrive, we cannot promise to tie every request, and fair usage applies.
9. Intellectual property
All content on this website (including text, photography, design and data) belongs to us or our licensors. You may use it only for your personal, non-commercial use of the website; copying, republishing or commercial exploitation of any content requires our written permission.
10. Our liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law, including your statutory rights as a consumer.
Our products are supplied for domestic and private use. If you use them for commercial or business purposes we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity, and you should ensure you carry appropriate insurance.
Subject to the above, our total liability to you in connection with any order is limited to the amount you paid for the products concerned.
11. Events outside our control
We are not responsible for delay or failure to perform caused by events outside our reasonable control. If such an event occurs we will contact you as soon as possible and take reasonable steps to minimise the delay; if the delay is substantial you may cancel the affected order for a full refund.
12. General
If any part of these terms is found to be invalid or unenforceable, the rest remains in force. We may transfer our rights and obligations under these terms to another organisation; we will tell you if this happens and it will not affect your rights. You may only transfer your rights under these terms with our written consent. If we delay enforcing any part of these terms, we can still enforce it later.
If you are unhappy with anything, please contact us first; as a family-run business we do our best to put things right quickly.
These terms are governed by the law of England and Wales and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
